Harrell, who had been on the jury tlie greater part of the day, was excused this afternoon by the srate. tbe state's attorneys using one of their peremptory challenges. His place was filled by Carl Roes. George Smith was excused from jury service by the defense on a peremptory challenge.After the jury was sworn in they were, sent to their room and a short recess was taken, after which the first witness was called to the stand.The case of the State of Indiana, vs. Miss Genevieve Parker, for assault with intent lo murder Mrs. .1. Wjalter Elliott one night In February. 1912, was called In the Shelby Circuit court this morning at ten o'clock. A delay of one hour was caused by the non-arrival of Hon. Eph Inman,, the Indianapolis attorney, who is ore of Miss Parker's lawyers.The defendant's •attorneys moved the court'that the affidavit be quashed The court overruled the motion. The defendant was then arraigned and plead not guilty to the charge. The work of selecting a jury to try the case was then begun and willprobably occupy the entire day. At the noon rccps* the jury box was occupied by twelve men, all lt;•■ whom had been questioned by the state and dofenpp.William -I. Buxton, n farmer of Xo bio township, was the only juror examined who stated that he had formed an opinion. He said that his opinion wouM have no weight in the trying of the case if evidence in a reasonable amount was introduced to disprove the opinion he had formed. He was dismissed for cause by the aitor. neys for the defense The examination of the jurors will he resumed this afternoon at 1:20 o’clock.Each side was given ten peremptory challenges by the judge. A spirited legal battle was waged by the lawyers over the removal of Juror Buxton. the state attempting to make the defense use one o: their peremptory challenges in dismissing him.The court room was well filled when the case was called, a large part or those in attendance were women.Miss Parker paid close attention to the answers given by the men in the jury box and several times talked with her attorneys. She seemed worried and nervous. She wag surrounded bv the members of her family and friends.When court adjourned at noon the twelve men who were in the jury box were instructed to have no conversation with any one in regard to the case and were warned against conversing with each other. Xone of them had been sworn In as jurors, but every precaution Is being taken for apapers but had not talked with anyone concerning; ft. Heppner oausodsurprise in the court room when he said that he had neither read uor talked about the case and that he had formed no opinion.Most of the jurors slated that they had read of the case In the newspa pers when the affair occurred and that they had talked of it. but when questioned as to whether they had formed opinions stated that they had not.Miss Parker sal on the west side of the court room surrounded by the members of her family and a large number of her friends. She was in a position to converse freely with her lawyers and she did so several times. She was attired in u natty blue suit and a green straw hat. On several occasions while her attorneys were questioning the jurors she would speak to them and another pointed question would be the result.Mrs. Elliott sat directly across the i room from Miss Parker. She was j seated close to Prosecutor Cheney r and Attorneys Carter and Morrison. | who are assisting him In the case. 3he seemed to be nervous and dreading the affair. .* Short Resume of Case.It is charged that o:i the even ng of February 15. 1912. Miss Parker entered the apartments at the home or Mr. and Mrs. \\\ A. Powell in West Franklin street, which were occupied by Mr. and Mrs. J. Walter Elliott, anil attacked Mrs. Elliott with a heavy wrench. The woman who entered'the room was 3mall and heavily vailed and held a handkerchief over her mouth. She carried a basket which she said had been sent to Mrs. Elliott by the Misses Wingate. When Mrs. Elliott stooped to take the basket she was struck over the back of the head by the veiled woman. Her screams frightened the other woman from the house, but In going she fell down the stairs and was seen to limp away. It pas found that the basket contained a hotrle of coal oil and Ikx of matches and it was supposed from this thatIhe veiled woman intended to lire the house after assaulting Mrs. Elliott.The affidavit was returned against Miss Parker by the grand jury April 1. 1912. When called before that body to testify several days previous. Miss Parker, on the advice of aitor. neys, refused to answer the questions asked of her. . vMr. and Mrs. Elliott n few months after the Incident left the city for I.os Angeles.
