John Duggan should oa do account, perhaps, assault and batter Mrs. Duggan, yet he was charged with doing so. A jury of his peers, however, decided according to law and testimony that he had done nosuch thing. Hence Justice Mills discharged him.Michael Nugent was accused of an assault and battery upon Mrs. Duggan. The trial was before the court without the aid of a jury. James Wilsh was Prosecuting Attorney. He laid down the law, plied arguments, snd eloquently appealed in behalf of broken law, a violated constitution, and the invasion of the personal rights, safety and comfort of his client. His effort is said to have been eloqnent in the extreme, scintillating with legal lore, and corruacating along the route which linked his premises to their conclusion. But it was all “ no go,” Michael was discharged.
