Coart Ho«9€ News$6,000 DamageSuit Is FiledqSiPIA $6,000 suit was filed in common pleas court yesterday by Herbert Worthington, Jr., ^ 18.through his father of 1151 Ridge avenue, for injuries sustained the night of April 29 when he was as-»aulted at Main and Fifth streets.The action was brought againstEdward O. Smith., 19, through his father, George D. Smith of 14081'Linden avenue.According to the petition, young Worthington as struck in the mouth and sustained a wound on the lower lip, lost four teeth and had a partial plate damage.Young Worthington at the time, filed an assault charge against the Smith youth who was fined $25 and costs and given a suspended 10-day jail sentence after he pleaded guilty .in municipal court the following day. Smith, when arraigned, explained to the court that he erroneously believed Worthington.^ to be the person who had driven by the Fifth and Main stivet Intersection on two or three occasions a short time before, and asked him (Smith )if he wanted to fight.Attorney Don Mallett represents tha plaintiff.htlafteFytlt;
