Woman deemed mentally ill at time of man’s murderBY AMY CAHILLStaff ReporterGlenda “Gail Robinette may be given a second chance at freedom.Robinette. 49. of Anderson, was convicted in 1999 of shooting herex-boyfriend five times, furorsfound her guilty of murder, criminal confinement and burglary resulting in bodily injury, but mentally ill.She is currently serving a 55-year sentence, but the Supreme Court of Indiana ruled earlier this year she must be retried. Her new trial will begin Tuesday afternoon in Madison Superior Court 1.The Supreme Court found Judge Dennis Carroll should not have allowed jurors to view a videotape of Robinette refusing to talk to police.Despite her unmistakable assertion of (her right to remain silent) she was interrogated first for 3 hours and 15 minutes and a second time for 45 minutes. The videotapes of Robinette’s interro gations were admitted into evidence over the objections of defense counsel and are the basis of this appeal, the Supreme Court ruling said.Court records show the state argued the videotapes were significant because they showed Robinette understood her rights and responded appropriately to questions.Robinette and Michael Gougeon dated for five years before ending their relationship. Following the breakup he began dating Carrie Sherman, court records show.Early in the morning Sept. 6, 1998, Robinette went to Sherman’s home, where she found the couple in bed together, according to court records. Robinette shot Gougeonfive times before forcing Sherman to leave the house with her at gunpointShe drove to a nearby church parking lot and ordered Sherman into the trunk of the vehicle. She later abandoned the vehicle with Sherman still in the trunk, court records show. Police found Sher man several hours later.Robinette surrendered to police three days later at the IndianaSee Robinette / A4
