The case cannot come up in the Circuit court until the regular docket is disposed of, whijh will be in about a week. The reason for these proceedings are thus explained by the Express: The oftenso of keeping a house of ill-fame is a continuous one, and the law makes one conviction a bar to any other suit which might bo pending on a charge of the same kind for acts previously done; just as a man cannot be tried twice for killing auothor. The object of the state after finding that Mrs. Volger meant to resist prosecution, was to prevent by frequent arrests before justices of the peace a continuance of her practice until an indictment could be returned in the Circut court. * After this was done it was useless to prosecute further tho causes pending before the justices, as in case of conviction the defense would, in all probability, appeal the caso to the Circuit court. Bv the law cases so appealed could not be tried until the September term, whereas the indictment returned this week can be tried at the present, and since there can be but one conviction for past offenses it is desirable to convict under the indictment as it can be done more speedil3r. A conviction for what she has done will not prevent action against her if she continues to keep her bouserunning.Chief Fasig and Deputy Prosecutor D. N. Taylor, who has this case especially in charge, say that it is the intention of the state to move the mad-atne from south Sixth or know why it cannot bo done.
