Woerner wants rape charges dismissedBy JEFFREY B. ROTHTimes Staff WriterA Cumberland Township man charged with raping a 14-year-old girl appeared in court Tuesday to argue that the charges should be dismissed.Carl G. Woerner, 51, of 1195 Herr’s Ridge Road, Gettysburg, was originally charged by Trooper Dermis P. Kern of the state police at Gettysburg with two counts of rape, and a count each of indecent assault and corruption of the morals of a minor.At a Feb. 2 preliminary hearing before District Justice Thomas R. Carr in Gettysburg, one count of rape, which requires forcible compulsion, was dismissed. All other charges were held for court.Attorney Jeffery M. Cook of Wilcox, James Cook, who represents Woerner, filed a writ of habeas corpus on April 28 seeking dismissal of all remaining charges.Police allege that on Jan. 14, at about 9pm., the 14-year-old girl accompanied Woerner on a snow plowing run. The girl testified that Woerner parked the pickup truck to the rear of the Gettysburg Country Club and began fondling her. She said that Woerner asked her to get into the rear of the truck where they had sex. At no time in her testimony did she indicate that she resisted or told Woerner to stop.(See RAPE on page 2A)
