$500,000 bond set for accused murdererALBUQUERQUE (UPI) - Testimony a slaying victim lay wounded and helpless when he was finished off with two bullets in the back persuaded a magistrate Thursday to set bond at $500,000 for an 18-year-old man accused in the killing.Assistant Public Defender Bill Walker said he did not believe his office would appeal the high bond set for James Christopher Foley, who is charged along with a 12-year-old companion in the killing of Patrick O’Rourke, 34.O’Rourke, a father of four children, died early Tuesday in a robbery at the 24-hour grocery store where he worked nights as a clerk while studying days at the University of Albuquerque.Foley appeared Thursday beforeMagistrate Curton Cosgrove, who set the bond after Assistant District Attorney Martin Diamond described the circumstances of the slaying.Diamond said O’Rourke was shot once inside the Circle K store by one of two bandits and then was shot twice in the back outside the store where he had chased his assailants.“I think the court should also take into consideration that at the time, this defendant saw fit to have with him a 12-year-old child,’’ Diamond said.The juvenile, who had run away from home earlier this month, is in custody pending a Children’s Court hearing.Police said they arrested Foley and the 12-year-old at a bowling alley Wednesay night
