Mr. Smith testified. He asked me to go to his home for the night and waited until he was sure I could get a room at the hotel before he left. He was cheerful and we talked for some time.Mr. Smith's testimony is designed by the defense to break down thestate’s contention that Bigham. an- ' gered at alleged revelations concern- ■ ing his wif« made by Mrs Oarda Yonkers, at a meeting on a side1 street of the village, rushed home I and killed her in a quarrel. !lr. W. It. Olds. 70. Attica physician. lt;ailed to the Bigham home after the tragedy, declared his belief today that Mrs. Bigham committed suicide by driving the dagger into her heart. ' A little black note 'book in which, ' Dr. Olds testified at the first Bigham trial, he had made entries concerning suffocation the day after the tragedy. 1 has been mislaid, he told the court yesterday. Dr. Olds recalled the entry. but said his memory failed as tothe date.The defense is making rapid progress and has completed the examination of fifteen of the thirty witnessessummoned.A motion to require the state to elect whether the case should go to the jury on the count of the indictment charging stubbing, or that charging suffocation was overruled . by .fudge William F.
