Claims to Have Suffered Men* tal Anguish and Lacerated Feelings Because of Die* appointment.A breach of promise case has been filed in common pleas court. Cathe rine O. Halter, a young woman of i Canton who resides on Navarre street through her attorney, Joseph M. Blake, has filed a petition alleging that Gustave F. Volzer, who lives on Charles street, this city, refuses to earry out his agreement to marry her.The petition recites that she and the defendant in the latter part of January or early in February, 1900, entered into a mutual promise and agreement to marry each other; that it was agreed that they should be married on February 28, 1900, but that on the date set for the wedding. Volzer refused and neglected to carry out his part of the contract.It was then agreed that they should be married on the 25th of April, 1900, she says, but again the prospective groom failed to keep his agreement The date was then set for November of i the same year, and again the defendant utterly refused to marry the plaintiff Miss Halter says that she made preparations to consummate the marriage each time the date was fixed and was at all times ready and willing to marry defendant, but on his part he has wholly failed to fulfill his agreement to marry her, though she has frequently requested him to do so.By r€»ason of Volzer’s failure to carry out such contract, she says she has suf-| fered great mental anguish, that her affections have been disregarded an.l ! blighted, her feelings lacerated and an ' advantageous marriage lost, and that j by reason of the fact her health has been greatly impaired.The plaintiff asks damages in the sum of $5,000 and costs of prosecution.
