DuWayne Pivett, 24, who lost , an eye as the result of being hit ' in tils face with a beer glass, is asking that amount from David G. Gilbert, 24, of 222 Rosemary ' Ave., and Joseph Bauer, owner ' of the Anchor Inn, 1970 Atwood Ave.Gilbert was acquitted last June ' 11 by a Circuit Court jury of aggravated battery Sn the ease. The ’ Incident took place Dec. 23, 1962, in the Anchor Inn.The trial Wednesday will mark the first appearance of Ally. Jack McManus before Judge Maloney since March, 1963, when the lawyer was fined $250 for contempt of court.McManus has consistently filed affidavits of prejudice against Maloney, He has taken part in pre-trial conferences before Maloney and court motions, but this will be his first trial before the judge since the contempt action.McManus represents Gilbert in this case and has filed a counter-! claim against Pivelt and Bauer For $30,000.Atty. Vertio H. Peckham represents Pivett and Atty. John Jens-weld represents Bauer.
