(Collie) Kite in Printz’s saloon here last Tuesday night, took a new turn today, when Commonwealth s Attorney William F. KeyBer ordered Lucas re arrested and taken to Luray jail, pending application to the oau commissioner of Page county for release on bail. Lucas was released on bail Wednesday in the sum of |1,00*0 by the town authorities and has since been at liberty. The charge against the accused is a felony and the bail commissioner is theonly officer, aside from the Circuit Judge, who has authority to release him on bail. After learning that Lucas had been released on bail, the Commonwealth s Attorney come here and made an investigation. He directed that the bail bond be quashed and the accused be brought to Luray this evening on No. 14. Lucas became ill this afternoon and the officers put off the trip until tomorrow morning. He is held under guard tonight at his home over the saloon. It is understood that the bond of $ 1.0lt;M, on which Lucas was released, is regarded as entirely too light by the county authorities in view of the tact that Kite has not yet been pronounced out of danger by the physicians attending him. Lucas will be compelled to make a strong showing when his application is heard by the ball commissioner tomorrow before he will be released and it is possible that he may be held without bail until Kite's recovery is definitely assured.Kite was shot through the left lung, the bullet from a 38-calibre blue steel revolver entering the neck just above the collarbone and lodging against the left shoulder blade. No operation has been performed to remove the ball. The wounded man was jesting fairly well tonight and, should no complications arise, he is expected to get well. The action of the Commonwealth’s Attorney in ordering Lucas’ re-arrest caused a postponement of the preliminary hearing of the accused, set for today,The case against Lucas will be vigorously prosecuted, despite reports being circulated to the contrary. The shooting occurred after Kite, bartender in the saloon, had refused to sell Lucas more whiskey. Lucas first became engaged in an alterca--4iun with Kite’s father, Hiram J, Kite, member of the Board of Super visors from Shenandoah district, during which Lucas fired once, the bul let going wild when the elder Kite knocked the barrel of the gun into the air. Then the son interfered and in the melee that followed, Lucas shot the younger man.
