The decision of whether to have a jury is left up to the defense.Curry said a date has not been set for the hearing, adding that it probably will not be in the near future.“Seard will be examined by experts for the defense before this thing goes to court, and that can take a while,” he said.The bodies of Kutzer and Ingram were found in March 2003 in the driveway of Kutzer’s Comfort home.
