The decision of whether to have a jury is left up to the defense.Curry said a date has not been set for the hearing, adding that it probably will not be in the near future.“Seard will be examined by experts for the defense before this thing goes to court, and that can take a while,” he said.The bodies of Kutzer and Ingram were found in March 2003 in the driveway of Kutzer’s Comfort home. According to police reports, the two were bludgeoned to death.Ingram’s son discovered the bodies and called police.Seard left behind several key pieces of evidence against him at the crime scene.Police reported that Seard’s driver’s license and a picture of him self from a compact disc advertisement were recovered.Contact Cateto Chapman at
