Hung Jury.The case of Samuel Roberts against Dr. John A. Ritter, both of West Baden, was on trial in court this week. The case began Monday and went to the jury yesterday afternoon, and after an all night session was discharged this morning, failing to agree on a verdict. This was a suit for damages for personal injury, loss of time, etc., on account of Dr. John A. Ritter having shot and wounded Samuel R. Roberts, Marshal of West Baden in a personal difficulty in June, 1907. Dr. Ritter was prosecuted later on the charge of assault and battery with intent to murder, but at the trial was acquitted on the plea of self defense. This present trial was hotly contested, some of the best legal talent in Southern Indiana being employed on both sides.The jury trying the case was a struck jury and was composed of the following gentlemen:William J. Hill, Joel T. Newlin, Edward Apple, Alfred M. Collins, Ross Stout, E d w a rd Springer, John E. Martin, May Wright, Frank Fisher, Harvey Huston, Thomas Sears and Albert Heise. On account of Judge Buskirk being related to the defendant Judge W. C. Utz, of Floyd Circuit Court sat in the case as Special Judge.
