► NASHUAMan cleared of assault charge: A city manwas cleared of assaulting a 16-year-old girl lastmonth, after the prosecutor dropped the charge forlack of evidence.David Houston-Booth, 40, of 3 Killian Drive, wasarrested March 8, 1995, on charges that he assaulted and sexually assaulted the girl, an acquaintance of his step-daughter, at his former home in 1994.Houston-Booth was found innocent on the sexual assault charge after a trial in Nashua DistrictCourt last summer, but convicted of simple assaultfor allegedly grabbing the girl, pushing her onto abed and kissing her.Houston-Booth appealed the conviction to Hillsborough County Superior Court. On Feb. 22, theprosecutor dropped the charge after learning thatthe girl had admitted to making false statements inprevious testimony, according to Houston-Booth'slawyer, Eric Wilson of Nashua.Assistant County Attorney Simon Brown wrotein court records that the charge was dropped “dueto fatal discrepancies in witness' prior statementsand testimony.”Houston-Booth has filed a petition to annul the case and wipe out any record of his arrest and conviction in district court. It is scheduled to be heardApril 26.
