COURTSW.Va. man receives prison time for high-speed chaseBy EVAN GOODENOWThe Winchester StarWINCHESTER — An Augusta, W.Va., man who led police and a fire marshal on a chase that exceeded 100 mph received a 30-month prison sentence in Frederick County Circuit Court on Friday with all but seven months suspended.In a plea bargain, Ryan Lambert Barnes pleading guilty to eluding police and driving with a suspended license. He received two years with all but 17 months suspended on the first charge and six months suspended for the second charge.The conviction is over an Aug. 11 chase, according to a criminal complaint by Deputy Tyler Spears of the Frederick County Sheriff’s Office. It began with a traffic stop by Frederick County Deputy Chief and Fire Marshal John “Jay Bauserrnan at 4780 Northwestern Pike (U.S. 50). Fire marshals have law enforcement authority in Virginia.Bauserrnan said he made the stop because Barnes was driving recklessly, including running multiple vehicles off the road and swerving onto the shoulder of the road. He said during the stop, Barnes smelled of alcoholand appeared to have urinated in his pants.“The driver stated, All I did was throw a can from rny car and you stopped rne?’ The male then stated he had been drinking and was on probation and was not going back to jail,” the complaint said. “The male then said ‘[Expletive! you' and ran back to his vehicle and sped off.”Barnes was later stopped by authorities with the Hampshire County Sheriff’s Office in West Virginia. He registered a 0.17 blood alcohol content — more than twice the 0.08 legal limit — in a portable breath test and was charged with driving under the influence, according to the complaint.As part of the agreement, Barnes loses driving privileges for 15 months and must pay $250 of a $500 suspended fine.
