OddsentArrested For Stealing Cow Peas.of Inch—Areet|( ,x) ■ Bert Kirkham, of this city, who P ! operated a photograph gailary in a tent on Main street last summer, was arrested and placed in the county ,v*tl1 i jail last Thursday on a charge of be-o:' ing implicated in the theft of twelve 'ly s . bushels of cow peas from the ffice ace, i building of the old Fertilizer plant, west of town, on Sunday night,, March 14th. The peas were the pro-icnt perty of Marvin Phillips and Miles *e Murphy, but the affidavit against 0 Kirkham was made by J. H. Davis, a well known and respected farmer, of west of town, whose son, Ilor-the j schel, a lad of 14 years, was made a 3io-j party to the affair through the in-in- | fluence of Kirkham. George Master-D a ! son, another young lad of the com-eral munity, is the third party implicated lfif. in the disappearance of the peas, and » is he is said to have done the real work fice i of getting the stolen property out of fiity i the community. Masterson owns a jire horse and wagon and he employed ing these in taking the peas to Walkerton For j where he is said to have sold them ap-; for $2.00 per bushel. The under-I standing was that he and Kirkham leal i were to “split” on the returns. Mas-1 3le, ! terson was also placed under arrest )re-1 lust Thursday and after a preliminary ' r»-lt;i for | hearing in Squire Rogers’ court was j ent bound over to the circuit court for aft, I trial. He was later removed to the hat; LaPorte county jail by order of court or” for the purpose of keeping him away will | from Kirkham before their cases ook ; come up for trial. Masterson and )eS; ; Davis were staying at Kirkham’s ells j home on the night of the robbery, i •ks, and according to their story he called them from their bed during the night and compelled them to go after the peas. Young Davis would have nothing to do with taking the peas out! of the building and he left Masterson j and went to his own home when! they reached the Lundin farm on the j return trip. He was given a hear-1 ing before Judge Pentecost in a ju-j , | venile court proceeding and was later 0 a permitted to return home with his, father. From his story to the court it is plainly evident that he fell info bad company and that he was in no way responsible for the theft. Kirkham’s trial is set for next Wednesday, March 31.Aw)USft HitAllghtn’theyandud-lisseekIek.ketorege-assJayA
