New Trial Denied In Murder Case»Dist. Judge John B. Me- 1 Manus Jr. has denied a de- ffense motion for a new trial for David Jose Tapia, 28, con- ( victed recently of second-de- i gree murder. fTapia was found guilty of Ithe shooting death last Oct. I 7 of Tony Prado Chapa, 24. a I bartender at the Elbow Room I Bar, 210 Second SW, and was I sentenced to 10 to 50 years I in prison. IThe defense, which filed a I notice of appeal in District I Court Monday, had asked for a new trial on the grounds that the court erred in putting the defendant to trial during the same term of court in which he had his preliminaryhearing. JThe defense also contended that Tapia was denied hisright to an “impartial jury,” and that a mistrial should have been declared due to“misconduct by the prosecutor.
