HUFFMAN DECLARES THAT SOLOMON STEWART IS NOT CAPABLE OF ATTENDING TO HIS FINANCIAL AFFAIRS.CAVESigned Notes and Sold Land to Pay For An Automobile Purchased By a Son—On Stand All Morning.a7 n 7 iL \ (From Monday’s Daily.)I_ The second week of the March term of the Shelby Circuit court bc-3 gan this morning, when the case of John Lt Huffman against Solomon Stewart was called. Tht plaintiff Is demanding that a guardian be appointed for the defendant, alleging that the man, who is nearing bis eightieth birthday anniversary, is in need of some one to care lor his business affairs; that he is not capable of doingso on account of his advanced age.The defendant was the only one on the witness stand this morning and he was on the stand for more than an hour after the jury was selected. At one time be stated that be was 76 years of age in 1B07, another time he staled that he was 75 years of age In 3908, and a third time he stated he was 76 years of age in 1909. The evidence showed that the defendant had given away his money to his children, had signed notes and had sold some of his land to make a payment on an automobile bought by his son. He had also signed one cote, according to his evidence, for Willard Huffman and had to pay It, and there were other notes mentioned in his evidence.There are a large number of wit-nesss in the case, and It will take up at least all of today and the evidence may extend Into tomorrow.Steve Mohr was on the witness stand this afternoon and he testified that here was a bunch of steers in Stewart's land between one and two years ago and that one of his steers was among them. He went to drive a steer out of the field and Stewart claimed the steer was his while Mohr claimed that it belonged to him (Mohr); that he had only had it a short time. He knew it by its long tall.Mohr also said that Stewart paid him some Interest at one time and that he was fifty cents short in the payment and that he brought the fifty cents the next day. There- was nothing strange In that, according to the remark of Judge Hord after Mohr had testified to the fact.The jury eharlng the case is composed of the following men; Conrad Kuhn, Union; Ed Zike, Hanover; Moses Logan, Hanover; George A.
