She also ruled that Kapoor “intentionally inflicted emotional distress’’ on five of the plaintiffs.Eastern New Mexico Medical Center Inc., a nonprofit corporation that operated the then-county-owned ENMMC, also had been named as a defendant but settled out of court for an undisclosed sum.Community Health Systems Inc. of Brentwood, Tenn., bought ENMMC from Chaves County in 1998.Vazquez awarded compensatory damages of $250,000 to Netsch, $375,000 to DeBaun, $500,000 to Sanchez, $250,000 to Gonzalez and $500,000 to DeLosSantos. Additionally, all five were awarded punitive damages in amounts matching compensatory damages.Court costs, attorneys fees and interest will be added to the $3.75 million.Messages were left seeking comment from Kapoor and from defense attorney Mark Jarmie on Sunday.Tandy Hunt of Roswell, who with Albuquerque attorney Kathryn Hammel representedNetsch, Sanchez and Gonzalez, said the case “illustrates that matters of human dignity for women and those who enjoy different national origins are entitled to respect in the workplace.’’Randy Clark of Roswell, who represented DeBaun, DeLosSantos and Nieto, said the phrase “hostile work environment” describes a situation in which “you discriminate and do enough bad things against a person in the workplace that it eventually crosses a line that the environment becomes hostile.”Hunt said the punitive damages were important because “the judge awards those to set an example and say if people are going to make a choice to engage in this behavior, then they are subject to being penalized, and it’s a very expensive choice that they make.”Netsch is a registered nurse who worked in the hospital’s radiation oncology department from September 1994 to May 1995. DeBaun is a certified radiation therapist who worked in the department during the same period.
