When I moved the Mayor’s Court opposite to the Pico House, in December last, most of the policemen refused to take prisoners there, alleging that said office was too much out of their* way. This was a mere pretext, but as 1 intended to move the Mayor’s Court and office near the jail as soon as I could secure a suitable building, I did not complain. On the 25th of February the Honorable Council ordered the police to take all prisoners beforeTHE MAYORFor trial, as soon as the Mayor.’sCourt would be litteu up. The defendant pleaded guilty and was by me sentenced and paid ids tine. As to the other two prisoners, they were to be brought lie-fore me this same day (11th instant) at half past 1 o’clock in the afternoon.1 made it my duty to be on hand at the appointed hour, but they failed to appear, although I waited for them till near 3 The following day I heard that those two prisoners had beenAn Explanation.The following is reprinted from the Express at the request of a number of our leading citizens:A representation signed by a number of respectful and influential citizens was made to Governor Pacheco, requesting him to postpone for a few weeks the execution of VTasqucz, so that in the meantime steps might be taken to capture the remnant of the Vasquez gang, and thus avert any act9 of violence which, instigated by the spirit of revenge, they might inflict on innocent persons. This undoubtedly would have been a good measure, but His Excellency took a different view of the matter, and his answer is contained in the following communication which appears in the llecord-Union of March 17th:Governor Pacheco received yesterday several letters and telegrams from San Jose and Los Angeles, urging that Vasquez, who is to be hanged on Friday next, be reprieved. His decision was announced in a dispatch to Vas-quez’s counsel, of which the following is a copy:Sacramento, March 16th, 1875. To W. II. Collins, Son Jose, California:Your letter i.s received. I am unable to perceive any good reason for intervening between Vasquez and his sentence; nor is there any eaturc of the case that can with propriety be invoked to delay the vindication ofrhe law. cY plea for mercy is always strong andpersuasive; but the quality is not genuine of that mercy which prolongs misery when there remale* no hope. I profess to be hu-main *, but true humanity does not requireni.s reprieve, which could only afford him u few more days of suffering. .K. PAchkco, Governor.Subsequently the following was telegraphed to Los Angeles in reply to a dispatch setting-forth that the exeunt ion of Vasquez would just now endanger the lives of innocent persons:Sacuamento, March 16th, 1875.To Yynticto Sepulveda, Volney K. Howard, andothers, Los Angeles, California:Your dispatch is received. I have already officially refused to reprieve Vasquez after a careful examination of his case, and have inode a formal announcement of the decision. I do not tuink anv danger that may exist from the gang could be .avoided or les-sened by a postponement of the execution. There would be the sam condition of affairs at the end of the delay, and for these reasons I must decline to interfere.K.
