Petersen Baking company- of Omaha, which' charges the defendant was indebted to the plaintiff company in the sum of $1,170.64 at the time he terminated his contract last Jan. 20. The plaintiff alleges Gibson entered into a contract for distributing cakes and bread baked by the Petersen company Sept. 30, 1926, and he dis- , continued the contract last January upon only two days notice, whereas the plaintiff alleges the contract required that Gibson give two weeks notice. An injunction action brought by the Petersen company against Gtbson, asking that he be restrained from representing the Colonial 'Baking company of Des Moines in this territory, was dismissed after it was filed with the clerk of court,A note action has been filed by. J. W. Redding against W. J. and Della 12. Gittins, whoare alleged to have given the plaintiff a note for-$392.80 Feb. 18, 1922, to mature in ten months, and which is still unpaid. The plaintiff asks judgment, for the note, interest and costs through his attorney, G. C. Dalton.
