She bled profusely and the gory linoleum taken from the kitchen floor was mute but effective evidence In the case.Contention of the state was that Bailey experienced a change of intent when he saw his bleeding victim and began to think of himself and what might happen to him. Ferrell. Connor and Brenaman hastened to the Centralia police station and at once Deputy Sheriff Emory Coleman and Policemen Parks and Baker rushed to the scene. Bailey was alone with bis victim when they returned and demanded admission. He left her and unlocked the front door, returning Immediately to his room, followed by the three officers. As they entered the room Bailey reached across back of where Mrs. Skinner was lying and picked up another rifle which was taken from him.It was testified that when Coleman asked Bailey what bad happened the latter replied that She shot herself, to which Mrs. Skinner made a prompt reply. No. I didn’t. Bob. you shot me, or words to that effect. It was figured that Bailey oven then was figuring how he might escape responsibility for the woman’s wound and that to save him possibly she might admit that she shot herself. There have been cases of this kind.Soon afterward Mrs. Skinner was taken to the hospital. She died there about 10 o'clock Tuesday morning, February 1. Bailey helped her toan auto in which the trip to the hospital was-made and on leaving there with an officer made special request that she be given every attention possible.The defense of Bailey was that the shooting of Mtb. Skinner was an accident. In his examination of the Jurors Mr. Thacker stressed this possibility with each of them. Bailey’s brother. John Bailey, was at Mrs. Skinner’s when Ferrell, O’Connor and Brenaman arrived there. Some 15 minutes later John Bailey went to bed in Emmet Bailey’s room. JobD Bailey testified that when Emmet worked the lever' on his rifle he awakened; that Emmet asked if there bad been any trouble I hat night; that when the first shot that landed in the hall celling was fired he heard Mrs. Skinner cry out from the dining room that she was shot. Emmet Bailey claimed that be heard her make this outcry. (Ferrell. Connor and Breneman, who were sitting in the room with Mr3. Skinner, all swore on rebuttal that she made no such outcry.) Emmet Bailey explained the first of the two shots that was fired as he entered the dining room as having possibly been caused j by the stock of the gun hitting the ! side of the door. He denied that he j had aimed the rifle but when pressed I as to just how he was carrying the | gun when the two shots were fired in j the dining room was unfortunately for himself unable to give any reasonable explanation of them.
