to facenew trialA former Atchison man faces a new trial in Johnson County after a trial last week ended with a hung jury. Paul Dale Zishka will be retried, according to Robin Lewis, assistant district attorney.Zishka, formerly of Atchison, is charged with rape, aggravated battery and attempted aggravated criminal sodomy. The charges were filed in connection with an Oct. 22 rape in Mission.Eight witnesses testified for the prosecution and Lewis said she presented evidence of two incidents involving Zishka that occurred in Atchison in the 1970s. Zishka was convicted of voluntary manslaughter and aggravated escape here and served about six years in prison before being paroled in 1984 Themanslaughter charge involved the death of Marsha Goodlet on Aug 27, 1978.Zishka took the stand in his own defense and was the only witness called by the defense.The trial began Monday and the jury began deliberations Thursday morning The announcement of a hung jury came shortly after 6 p.m. Thursday.Lewis said a hearing was set for April 14 at 3 p.m to set a new trial date. Zishka remains in custody inJohnson Countv.
