WYCKLIFFES WILL PROBABLY GO FREETahlequah, Ok.. March 16.—The irial of the Wyckllffe brothers, the alleged Cherokee bandits and outlaws. may be completed before the day is over. The Indications late this afternoon were that the defense would not offer any testimony and In the event tliat the court refuses to charge the jury to bring In a verdict of not guilty on the showing made by the state, then the Jury will be asked to return such a Verdict without the defense offering any testimony.The taking of testimony started when court opened this morning, the attorneys for the accused declining to make any statement to the Jury of what they expected to prove, saying that the boys were not guilty. Three witnesses were examined by the state this morning—Henry Hol-dormau. Ft am Woodford and .1. C. Penn—but they failed to directly connect the defendants with the killing of Deputy Marshal Gllstrapp, for whose murder they are being tried. The state expects to close Its case this afternoon and when this Is dono the defense will ask that a verdict of acquittal be returned.The Wyckllffe brothers are being defended by W. W. Hastings of Tah-leqiiah, Thompson and Park of VI-11IIa. and S. M. Rutherford of Muskogee.The two men on trial are sons of John Wyckllffe who for many years was a judge in the supreme court of the Cherokee nation.Following the killing of Gllstrap ‘.two years ago the Wyckllffes were : pursued Tor two mon'.hs by United States Marshal Darrough and 4 8 , deputies who were considered the best niarksni'-a iu the territory.
