CONTESTING FOR POSSESSION OF THE TEMPLETON LADZanesville Relatives Here to Resist Attempts of theMother to Retain Him.There was another chapter or two today In the matter Involving the custody and care of the eight-year-old son of Mrs. J. S. Stewart, formerly Templeton, which was spoken of in yesterday’s News. It will he remembered that Mrs. Stewart retained attorneys and began habeas corpus proceedings In probate court to secure the child ly her first husband when her overtures to .secure possession of the little one failed.It was predicted that the guardian, A. M. Templeton, who Is an uncle of the boy, or some representative or hlg, would be here before 24 hours had elapsed to fight the case after the sheriff brought the' hoy here from Zanesville. This prediction proved to be a correct one. The case was set for hearing before Judge Brlcker in probate court at 10 o'clock this morning and at that hour three Zanesville men were here. They were A: M. Templeton. Charles Baldwin and A J. Andrews, the first mentioned being the undo, and guardian of the boy. The guardian retained as hts attorneys former Circuit Judge S: M. Dougla6s and C. H. Workman, while A. A. Douglass and W. F. Voegele, Jr., were counsel for the mother, Mrs. J. S. Stewart. The attorneys for the guardian filed voluminous pieadiDgs with the court. Including a-copy of the will of the late Dr. B. F. Templeton, the boy's father The details of this will are given elsewhere.The attorneys for the mother asked that the case be postponed for hearing until after dinner and accordingly the court set it down for trial .at 1:30 o'clock. This was done to give the at torneys time to look over the papers filed by the Zanesville people. A. A. Douglass, attorney for the mother, then requested that the court make an Order to the effect that the child might be taken to the Stewart home until after dinner, but the guardian and his attorneys entered a vigorous protest against this and the court then ordered that the child be placed In the custody of the sheriff at the county jail tinttl the trial. Hester Harry Templeton, upon the occasion of his mother's marriage and removal to Mansfield, became a member of the household of Mr. and Mrs. 7. D. Templeton snd Mr. and Mr£ C. S. Baldwin, who live at the Templeton homestead on East Market street.The guardianship of Dr. A. M. Templeton continued and the child, for hs is a mere boy and frail-looking, was apparently contented and happy in rhe Templeton-Bald win home, he becoming particularly attached to Mr. Baldwin, with whom he spent a great deal of his time out of school, and with the family of Dr. A. M. Templeton, with whom he was a favorite.Dr. Templeton, the guardian, is at a loss to understand why the mother of tho child should wish to have the guardianship changed and tho child removed to her personal care. He is prepared to resist the action, having retained Attorney Andrews to go to Mansfield Saturday morning and oppose the habeas corpus proceedings which have been instituted and under which proceedings the child was taken to Mansfield Friday morning.Dr. Templeton made the emphatic statement that tlie case will be fought through .one court and .another until It Is decided by the higheet court, providing always that the case 1b decided against the guardian in the lower courts.. .It Is a fight for the possession of the child and hie money, is Dr. Templeton's .emphatic manner of expressing it.Mrs. Stewart’ nee Templeton, the mother of the hoy, was married to Dr. John Sloane Stewart in Columbus Nov. 13, 1901. Rev. S. S. Palmer officiating.C. S. Baldwin went to Mansfield at noon Friday. He was anned with a copy of the late Dr. Templeton's will together with certificates of Dr. A.9M.
