A Middletonian who will face three assault and battery charges. In Butler County Common Pleas, Court Monday was bound over, to the grand jury yesterday in Municipal Court on a charge of carrying a concealed weapon. Judge J. T. Lamb set bond for the defendant, James S. Madden, 4?, 1890 Logan Ave, at $1,000 on the felony charge Madden pleaded innocent and waived preliminary hearing. Madden, owner of the Red Bud Inn, was arrested Wednesday in a Central Avenue restaurant after police got a tip that he was carrying a gun. Officers said they found a loaded .32-caliber re volver in his trousers pocket. There were six shells in the gun and three others in Madden's pocket, police said. Madden told police he carried the gun to protect his money When Madden was taken to head quarters officers said they found only $125 in his possession. Madden's trial in Common Pleas Court at Hamilton on three assault and battery charges is set for 2 pm. Monday Another assault and battery charge was dismissed in Common Pleas Court, it was learned. He had been bound over to the grand jury here previously on four charges of assault with a dangerous weapon. Madden was later indicted on four assault and battery charges. Since a grand jury session ended recently, the new charge against Madden will not be considered by the grand jury until its May session. AT LEAST one defendant was prevented from getting to court by slippery streets and highways yesterday. The man had informed the clerk's office his car was in a ditch and he'd try to arrive by 9:30 a.m. when the traffic session began. When he failed to appear his case was continued.
