Whereas, at the November term of the* Circuit Court of Wirt county. West Virginia, 8a in 8 hep parti was convicted of the charge of murder in the tirat degree, and was «enieuc«lt;l to he hung at ilia penitentiary, March 11 lit, next, and “Whereaa, au appeal was taken to the Supreme Court of Appeals in thecane, Upon alleged error* in the (rial ' of the case in the Circuit Court of -•aid county, which appeal It as out been disposed of, ami cannot he determined before the nay fixed for the execution of the said Sheppard: and “Whereas, Messrs Hmwii *i,d Cast,*, counsel I »r Sheppard, have requested me to grant a stay of execution for the period of ninety day*, until a determinati in of the appeal hy the Supreme Court of Appeal* ot the State;*• Therefore, I, George \V. Atkinson, Governor of the State of Weal Virginia, in the intent of public justice, do grant unto the said Sara Sheppard a respite of ninety days from the first day ol March,I 190 I; and should the Supreme Court of Appeals refuse to gram him a new trial, I hereby direct ihe Warden ut / the Penitentiary :»f the Slate of West \ irginiu, at the expiration of this respite, to execute the paid Sheppard in Accordance with the sentence of the Circuit Court r»t Wirt Coumy.“Given under my hand mid the seal of the State, at the Capital, this 2t)i day of February, A.
