Charleston, \V. \ a—GovernorA(kiin’H) 11n8 Issued Uie fallowing pnicUmatidii, granting u stay of ninety days to Sum Sheppard, sentenced to hang fir murder, pending hi* appeal to the Supreme Court.41 Whereas, at the November term of the Circuit Court of Wirt county, West Virginia, Ham Sheppard was convicted of the charge of murder hi thlt;* first degree, and was sentenced to lie hung at the penitentiary, March 11 ill, next, and “Whereas, an appeal was taken to the Supreme Court of Appeals in thecase, upon alleged vrrora in the trial of the case in the Circuit Court of «*id county, which appeal has not been disposed of, and cannot he determined before the day fixed for the execution of the said Sheppard: and “ Wherein*. Messrs Brown and Casio, counsel t »r Sheppard, have requested me to grant a stay of ex-edition lor the period of ninety days, until a determitmtiin of the appeal by the Supreme Court of Appealsot the State;** Therefore, I, George W. Atkinson, Governor of the State of West Virginia, in the iute^en of public justice, do grant unto tho said Sum Sheppard a respite of ninety days from the first day ol March, 1901; and should the Supreme Court of Appeals refuse to grant him a new trial, I hereby direct ihe Warden ui/ the Penitentlary :»f the State of West \ ir^inia, at the expiration of this respite, to execute the eaid Sheppard in accordance with ih« sentence of the Circuit Court of Wirt County.“Given under my hand and the real of the State, at the Capital, this 28(11 day of February, A.
