AFFIDAVIT FILED CHARGES ASSAULT WITH INTENT TO KILL.Frank Stephenson Served Warrant and He Immediately Gave Bond for $1,000 as Asked.Assault and battery with intent to kill is the charge against Frank Stephenson, a Gadsden school teacher, in an affidavit of Claud Hillock, afarmer, which was filed in circuit court Monday afternoon, by the state’s attorney. Stephenson shot William Adair, a farmer, 20 years old, in the left arm Monday morning after Adair had attacked him in the roadway in front of the Frank Stevenson general store at Gadsden. Stephenson furnished bond immediately after the warrant was served. Bond of $1000 was fixed and E. O. Rogers, M. E. Ritchie and Volney Higgins arc the sureties.Had Been WarnedStephenson had been warned of an attempt which Adair and his alleged gang intended to make to “get him”, and- the teacher was advised to o^rjry a gun. Stephenson used this gun after he had been knocked down and battered about the face by his assailant.Hillock Makes AffidavitHillock apparently was one of thewitnesses to the shooting in view of his making affidavit to the supposed facts in the case. Adair was in Lebanon Monday afternoon, his in-! jury having been dressed. It is noi, expected that Adair’s injury will prove serious.
