Fla . to Birmingham and then be driven to Talladega for testimonyWeir is the individual defense witness Johnny Carroll maintains he purchased the 1964 red Chevrolet Impala from in the summer of 1969 Earlier in the day defense attorneys Huel Love and his wife Betty surprised the court by resting their case. It was thought the defense would call the 61-year-old Brewerto the stand in his own defense, but it didn't Love's abrupt move left the state with two witnesses in transit and the trial had to be recessed until 2 p m ThursdayWHEN THE TRIAL RESUMED McKmght. with the attorney general’s office, and Morrow, assistant district attorney from Selma, spent the rest of the afternoon rebuttingthe testimony of Carroll.Wednesday. Carroll said he signed the car over to then Sheriff Luke Brewer shortly before being taken to Calhoun County to face other criminal charges Carroll also maintained that he bought the car from Weir and the purchase was made in Attalla in 1969.The first witness the state questioned when the trial resumed for the afternoon session was Lt Thomas Taylor of the Talladega Sheriff’s Department Taylor was d k Id McKmght if he could find any record of “a William C Weir ever residing in Talladega County or Sylacauga.”Taylor said he checked arrest records back to 1968 checked phone directories and business office listings back to the same vear without finding Weir's name Sgt Roy McDowell testified that Attalla Auto Sales, where Carroll allegedly bought the car. did not exist and according to various records had never existed.THE DEFENSE MAINTAINS that Carroll signed over the car in question to Brewer in October 1969 before he and his wife were turned over to sheriff’s deputies to face othercharges in Calhoun County The slate called Mrs Carroll to the stand to question her on the bill of sale she used to obtain a tag for the vehicle in question She said the bill of sale she typed up and sent to the Talladega Probate office listed William C Weir as the former owner of the car and that she got the name from astolen credit card It is expected that Weir's testimony today will disclaim any dealings with Carroll or with the 1964 Chevrolet Impala Moore told jurors just before recess Thursday that he knew they were tired and ready to go home. 'T hope we can have this over with so vou can return to vour families for theweekend. Moore said Mrs Love said the defense would not cross-examine Weir and is expected to go immediately into their finalarguments
