Accused Pleads Not Guilty To 2nd IndictmentHARLAN, Ky. VP}—A new murder indictment in the 1951 shooting of a former city patrolman brought an innocent plea Saturday from Claude Beach as Daniel Boone Smith announced his withdrawal as prosecuting attorney in the case.Beach, indicted by the grand jury Friday, won his release from LaGrange Reformatory last December after being convicted and sentenced to life imprisonment for the slaying of Avery Hensley. Beach was released after the Court of Appeals ruled he was tried on a void indictment.Commonwealth’s Attorney Smith announced his withdrawal from the case Saturday, for personal reasons which he refused to divulge. Circuit Judge AstorHogg, who ordered Beach held without bond after being informed defense counsel would seek a venue change, named an attorney, Edward G. Hill, to replace Smith.Beach was re arrested after his release an a warrant obtained by Police Chief Fielding Hensley, a cousin of the slain officer. Beach had been free under 515,000 bond on condition he remain outside; Harlan County until \he grandf jury acted.
