Mabel Cain and William,*i«rsit■A*00Affidavits Against the Colored Atfste-crat—Assault and Battery and Intent to Rape Alleged.OGGGGMontraville Simmons, the colored “ I aristocrat, whose name tignred promt* til nently in a'flrst page article in last 0,1 weeks’ Times as having filed an ugly _ I affidavit against ••Mabel Roe?’ and ■u-1‘-John Doe.’^when the “cullud gem-iy- men” himself appeared to be guilty of Bt. a grave offense, against both ot the par* as ties, was made defendant in Squire I Newer’s court Monday to answer the ^ very charges alleged in tbe article re-ja- ferred to, and which though known to I every newspaper in Lugansport, on— Thursday o: last week, were supressed lor ignored, and a false report of the— matter published by all of them. IN•'Mabel Roe” and “John Doe” came = fore ward in Squire Newer’s court Mon- R day, and filed affidavits against fclm-0f ImonF, and their true names, which it •s I was impossible to obtain last week, nrove to be Mabel Cain and William ^ Epperson, while the name of the g'rl’s ■s uncle referred to is Joseph Hall. In a the complaint filed by Miss Cain, Mon-js traville Simmoos is charged with com milting assault and battery with at tempt, aud it is alleged that he offered her $3 if she would submit to „ him, which she spurned indignantly. The affidavit also recite9 that on the £ way to Logansport, while inthecus-[J: tody of an officer, Montraville Slm-mons tried to induce her to take a drink of whisky.11 The second affidavit filed by William Epperson charges exactly what was al-1JJ , legcd against Simmons in last weeks’ :*■ Q Times, to-wit: That on or about the P 26th of February, SimmoDs assaulted I f® Epperson with an ax; that Epper-*e son dodged and warded off the blow. re with a club, else it might otherwise * ^ I have cost him his life; that he and 11:0 Simmons clinched and tbe negro threw |— )f him in a creek, very nearly drowninghim.j The cases were called for tiial Mon-i{! day afternoon, and again Tuesday, but ^ owiDg to the absence of state witnesses. both were postponed until 10 o’clock this (Friday) morning, and if I th jj appearances are not deceptive, and 0 Montraville ddn’t succeed in squaring things with Epperson and tbe girl and get them to stout up, it would seem I — ,, that the colored aristocrat was at last .. up agaiost tbe real thing. Joseph Hell, with whom Mabel Cain made her home, and where Epperson was a boarder, has moved from the shanty he formerly occupied on Simmons’|® farm. The men declare tbe row with0 Simmons bad its origin in the inde-a cent proposal to the girl, and while Simmons has made various state*;P ments as to tbe cause of the trouble,■° notone has been advanced by-him !® tbat seems as plausible as tbat told by ° the prosecuting witnesses. e Simmons arranged- to effect a com*promise with Epperson and the girl1 Wednesday by agreeing to purchase r a marriage license and pay the sqfiirefor marrying the couple, but before p Montraville bad reached Squire New-I ers’ office be bad such a load of tangle-f? I foot aboard tbat he lost bis bearingsII and staggered back down tbe I river, leaving tbe contracting pkFfiean to bold the sack on the row.e ____
