J. Cochran acted with malice when he removed a row of 12 orange trees on property claimed by Mr. and Mrs. Marc Soderberg, adjoining the Cochran ranch, near Anaheim, and whether the Soder-borgs really owned the land occupied by the trees, were questiors involved today in the trial of a suit for 51495 damages, demanded by the Soderbergs from Cochran. Superior Judge Z. B. West was hearing the case.The damage suit was based upon removal of the trees, which the Soderbergs valued at $124 each. In his defense to the action, Cochran claimed that the trees were dwarfed and stunted and of no value and he removed them because they were on the border of the ranch and interferred with his cultivation of his own trees.He acted under the impression, also, that the trees were actually on his own property because the Soderbergs' predecessor had occupied the land and gained title through adverse possession, he claimed. This question of title was brought into the court proceedings today and promised to be one of the hotly contested points of the case.Attorneys Ames and M cl4 ad den and George F.
