These lots were sold to Italians on the instalment plan.After getting nearly all the money c^‘ the man who sold the lots, whose IVub* name did not appear in the proceed-1ings, disappeared. Then the lot-own- ( ,ew* ere found that the property was vote DX’ mortgaged to Lsux for nearly Ite full Jjjjj ol(* value, and that before they could get iin' a clear title to the land they must pay (Jgoff the mortgage.B 19 8latta, as trustee, it was shown, had interested himself to raise money to pay off the mortgage and had paid8. one-half the claim, when, it is alleged, ad Laux went among the Italians and nl3' warned them not to pay Slatta any more money, as he was endeavoring 8 °* to get control of the property.Vice Chancellor Pitney said the evidence showed this to be true.
