Dinwiddie disqualified himself late yesterday form serving in the Boone county circuit court trial July 3 of Margaret Waters (Gypsy* Horn, former University of Missouri coed, charged with setting- fire to a rooming house in May. 1949.Judge Dinwiddie asked the chief justice of the Missouri Supreme Court to name a substitute judge in the case on an affidavit filed by Mrs. Horn’s attorney. Edwin C- Orr.Two MotionsJudge Sam C. Orr askecl That a perjury indictment against Mrs. Margaret Waters, mother of Mrs. Horn, be quashed, and that grand jury minutes relative to tlie indictment be made available to Mrs. Waters. Judge Dinwiddie asked the chief justice to name a substitute judge to rule on those two matters.Mrs. Waters was arrested Wed- i nesday on an indictment. It! charges she made false statements regarding a piece of property she pledged in giving bond for her daughter some months ago.Attacks Indictmentsi Orr. in his motions .attacked the indictment as false, charged that it was obtained by fradu-lent representations, made in bad faith, and was designed to prejudice the jury which would try Mrs. Horn on the arson charge. He said that one of the witnesses endorsed on the indictment has bpen dead for two years and that at least some of the others did not testify before the grand fury.Mrs. Horn and her mother were still in jail today, occupying a cell jointly. They were placed there after they came here toattend a deposition hearing in Mrs. Honrs case.(
