Buford Owen were scheduled to go on trial on a murder, charge in connection with the death of Dr, M, A. Santa Cruz.The court and attorneys wore in the process of selecting a 12-man jury to hear this case at The Times* deadline.Panel NeededJudge John S. Draper explained’ to attorneys that a 13-man venire was present and that an additional panel would be drawn from thlt;? jury box as soon as it was determined how many of the original 13 would be seated.This will be the third attempt at the tWal. Previous trials were set for March 29 and May 22. A mistrial was declared on the second day of the first attempt and Defense Attorney Warren T, Messick asked for,and received a postponement on May 22. He gave his reason as not having received his fee for services rendered thus fanMurder Charged . Simmons and Owen are charged with murder in connection with the death Of Dr. Santa Cruz on February 6., The ^prominent Negro dentist died of injuries sustained when allegedly attacked by Simmons and Owen.He was, previous testimony has revealed^ attempting to telephone police via an emergency phone of an alleged attack by the men on two Negro girls when struck down.Owen is said to have pushed the dentist from the telephone while Simmons is charged with knocking him to the concrete pavement with his fist.*He died a few hours later while enroute to a Roanoke hospital for an emergency brain operation. * --cdeetttC
