Thompson. They are likewise aware of the fact that he used to be a resident of Boone county. It is pretty generally known that he changed his residence from Boone to Montgomery county Some years ago. while living Imre, suddenly took a notion to take a trip West and over into Canada. During his absence a Boone county grand jury acted naughty and presented an indictment against him charging ; him with embezzling quite a sum of money, from or.e Robert Slocum.In tHe course of time he was found and brought back here to answer said indictment. He gave bond, and the case has slipped along from time to time until on Monday of this week, when fre came here from Montgomery county, where he is the county attorney for the Democratic board of commissioner** not for the purpose of being tried on this indictment by a jury of his peers to establish his guilt or inno-cence^but if possible to get out through some ijiiirk of the law, and in this, as lias bn predicted, he was successful. His case went out of court on a statute providing for such dismissal where the case bad been continued without his consent. This allklavit we had intended presenting in full, but on inquiring for it at the clerk's otiice it was lost, and lost before it had gone on the record; hence a copy cannot be had. It was. however, an aihidavit from Mr. Charlton simply stating the fact of such continuance and Mr. Stokes, who was acting as Thompson's attorney, on the strength of that aliidavit, asked the dismissal of the case, bv reason of a«rstatutory provision and it was done, the state making no attempt to resist it. Jn it there is no denial of his getting the money of Robert Slocum, for which he was indicted. In fact, since the finding of the indictment Thompson has attempted to escape prosecution by a repayment to Mr. Slocum of the money which he was charged with having taken.
