Olean, June 21.—Removal from of fice of Sheriff Ralph F. Knight of Cattaraugus county, will be sought of Governor Alfred E. Smith as a result of a charge of cruelty to Joseph Lid, 21 years old, of Youngstown, C., a prisoner in the county jail at Little Valley. Application for Sheriff Knight's re moval will be made by Henry P. Nev ins, Olean lawyer and counsel for Lid, who faces a charge of first de gree murder in connection with the shooting to death of John Barber, 40 years old, of Olean, here May 15th. Sheriff Knight, in an order granted by Charles H. Brown, Supreme Court Justice, is called upon to show cause why Lid should not be taken from his custody in Little Valley and placed with a sheriff in another county while waiting for trial. The show cause order is returnable In Supreme court in Little Valley tomorrow. Justice Brown also orders Sheriff Knight to permit no person to see Liol except on written requests of the defendant of Attorney Nevins until the hearing and termination of the order. Liol in a petition to the Supreme Court charged that the Sheriff was present while officers of the Olean police department slapped his face and pulled his hair shortly after he was taken into custody on the day Barber was killed. He also claimed that after his arraignment before Peace Justice Rollin N. Prett in Little Valley he was taken from the county jail to the library of the court house, where he was examined by District Attorney Archibald M. Laidlaw and after he had answered that he didn't know to several questions, he under went several cruelties at the hands of Sheriff Knight. The beating, accord ing to Lio, included slapping and hair pulling because he “did not tell the truth.” It took place after the district attorney had gone, he said. Knight became Sheriff January 1st after serving as Olean deputy under Sheriffs Mallory and Annis six years. He has been active in drying up alleg ed wet spots in the county.
