Wike and Lawrence Sturgeon, of Connecticut, yesterday were told by Phil K. Oldham, assistant county attorney, to obtain more evidence before swearing out a murder charge against R. L. Benton in connection with deaths of George and David Smith, Connecticut capitalists, here April 26.Wike’s identification of Benton as the slayer was not sufficient, Oldham said he believed, to warrant charges against Benton.Wike was acquitted of a charge growing out of the slaying. He identified Benton Tuesday as one of two robbers who he said shot the Smiths when they resisted.Sheriff Hamilton had announced Wednesday that charges probably would be placed against Benton Thursday. The action was delayed, however, because of Oldham’s views and because the sheriff had not had time to work further on the case.It erroneously was stated in an | Associated Press item from Muskogee yesterday that murder charges had been filed against Benton. The charges have not been filed, but Fred Hamilton, sheriff, announced they would be soon, ihe Associated Press is glad to make this correction.
