A Cage From Franklin.An interesting and somewhat sensa-tional law suit occurred in the court of Justice McCullough Wednesday afternoon. This was the case of the people against Richard VanWinkle, of Franklin, the prosecuting witness being Moses Burnett, who charged the defendant with carrying concealed weapons. According to the evidence adduced there has existed a feud between Burnett and VanWinkle for a number of years past, which has at times nearly broken out in open hostilities. Away back in July, 1890, Mr. VanWinkle was driving through the country between Franklin and Waverly and stopped at the gate of a farmer named Kennedy. While conversing with Mr. Kenndey and some of his neighbors who were there Burnett drove up in a buggy, and springing from his vehicle drew a knite and threatened to cut Mr. VanWinkle’s liver out. Said Burnett, there has been trouble between us long enough. Now you must cut out or shoot out. ”It would appear,however, that VanWinkle had anticipated an attack of this kind, and quietly reached down in the bottom of his cart and drew therefrom a revolver which he insinuated into the face of the belligerent Burnett. Seeing that his opponent was prepared for him Burnett ran over to the yard fence and siezed a shot gun which belonged to one of the farmers who was present. The prospects of a battle with light artilery was imminent and bloodshed would probably have been the result had not the bystanders interfered. The trouble was then dropped, but recently the old bitterness was revived and culminated last week in the arrest of Mr.Van Winkle on the charge as stated. The prosecution was represented by Judge M. T. Layman and the defense by Judge 0. P. Thompson.
