LAVIN ASSAILANTSFINED $25 APIECECONFLICTING TESTIMONY AT TRIAL PUZZLES OLIVIA JUDGEOliver Lyle and Clarence Welch of Redwood Falls were fined $25 each when convicted of third de-j gree assault upon Bernard Lavin, also of Redwood Falls, in justice J court at Olivia Friday.\ The pair were charged with | beating Lavin in the village of ! Morton May 16. Lavin sustained a broken cheek bone and lacera-! tions and bruises of the face and ! chest in the affray.Although Lavin had previously i told the Gazette and authorities ; here that he was alone at the time i of the attack, Lyle and Welch * produced witnesses who testified Alfred Leith of the Sioux agency was with him. Leith said he was riding with Lavin and Levi Leith, another defense witness, corroborated his statement.Judge L. C. Ployhart, who heard the case, said there was conflicting testimony as to the exact scene of the brawl. Its location took on importance since drivers’ licenses might have been suspended had a state highway been the arena.nnAAT717TT T 17
