Hayden told him the pistol with whichLockard shot himself belonged toher, that she kept it to defend herselfIt ever necessary ; she said she andLockard tied been drinking beer;shewas looking out the window when she heard 11 noise like that or a shooting cracker and turning she saw Lockard lying on tho flo.ir; ho thought It was 15 minulo* after one when lie met the party going to the houle on Filth Street; he said the women told him Lockard was familiar with ilie house and knew where she kept her pistol; bo entered the room fust after the shooting; ho turned up tho light and felt Lockard’* pulse, telling those with him at the time that Hcout was dead ; witness said lie took the pistol trom under Lockard, who lay on his right side, face downward.Charier Ilorniker was next called; witness said Lockard and Caddie Hayden earn© to his saloon, sometime after 8 o’clock and drank three glasses ot beer; Scout acted as though he was in a liappy frame of mind; they stayed there three quarters o( an hour.John Allen, bartender at Cruzan’a aa’non, was called: Lockard and Caddie Hayden came to our saloon about 10 o’clock and drank 0110 glass ol beer f ach ; I went to bod between 10:30 and 11 o’clock and heard a knock at tho saloon door shortly alter going to ned but did not answer.Frank Kiefer, watchman at Qra ham's spoke fictorv, was called; he heard a shot between 11 and 12 o’clock Monday night, but could not say where the report caino from.Minnie Duncan lived in the house where Lockard was killed ; she said Mrs Hayden had liyedovor her about two months; she heard no report ot a pistol shot; Mrs Ilaydtn showed her a pistol Monday two weeks ago saying that If certain pirtics came back there again they would got what they did'nt want.Miss Ona Todd testified, “I heard a report that night but it sounded like a smothered sound rattier than a pis* tot shot. Soon after t hoard .somebody run past my homo.Mrs Cash testified. 441 knew MnHayden kept a pistol,1’she said. ‘She kept it to defend herself with.’1Salhe Duncan testified that she heard Mrs Hayden tell Lockard44 Will, I'm tired of tiiis and won't stand itany longer/’ 1 did not hear what he said. They were coming up Central Avenue from the tiver. I was going down Main street. It was half past nine o’clock.ilorniker was recalled and said Scout wanted to sell him a pistol two weeks ago but that he told him he (fieriiker) had 15 pistols already.Frank Lockard was call d. 4T saw Scout, my brother at noon of the day the trouble took place. Scout was there and apparently happy.The case rested hero until this morning.THIS MORNING’S TESTIMONY.Mrs. Lera McLaughlin testified this morning. She said L ckard had declared in her piesence that he would not liye without Caddie Hayden.Nellie Sullivan told about the same btory as Mrs McLaughlin, her mother.Sam Johnson testified having seenLoskard give Mrs Hayden a revolver two weeks ago.Will Hoskins testified the same as other witness.George Bartron testified giving weight of the bullets of the revolver used.Coroner Murett testified having been called to goo the dead man. lie noticed powdor marks on his face and further testified that the wound he found, produced Lockard’s death,Caddie llayden took the stand and retold her story.The taking of evidence was com* pleted shortly before noon and after a briof summary of tho evidence Squire Cravens rendered a verdict which was to the effect that the evidence did not warrant his holding Caddie Hayden to answer (he charge of murder and she was therefore ac-nuitted. The defendant took the verdict In an Indifferent mood as though U was just what she expected.Tho only logical conclusion now to be arrived at is that Scout Lockard committed suicide.Judge Allison the defendant’s coun sel, complimented Prosecutor Bear011 the able manner in which he conducted the investigation.
