Judge Test’s ficst term was held at the bouse of Benj Brown, near where the village of New Marion now is found, on Tuesday, July 23, 1818. Martin Ovetturf and Lewis Myers, both ot Brown township, became bondsmen for the hew Clerk, in the som of $2,500. Sheriff Kirby returned into court, as the first arand jury, the names of James Wooley, (foreman).Henry Banta, Jero. Silyers, Charles David, Jere Talbot% Joel Kirby, B.Brown, Samuel, Overturf. James Whit-ham, Jacob Roberts, Mathew Patton,John McDonald, Carney Goodrich, Wilson Buchanan, Wm. Bucanan, Henry O’Neal, Daniel Wooley, Joseph Clark and Jas. Steele Of these Jas, Whitkam, Samuel Overturf, Charles David, Wilson Buchanan, Wm. Buchanan were fror*. Broprn township, and Jero. Salyers from either Brown or Henry township, James and Daniel Wooley, Jero. Talbott, Jacob Roberts, James Steele and Henry O’Neal, from Johnson township, Joel Kirby, “Bartlett Brown, and Henry Banta, possibly from Shelby township—Messrs. Clark, McDonald, Patton and GoodriohI never knew and cannot locate. Nathaniel French and Wm. Hendricks (ot Madison, a little later Governor and U. S. Senator) were soon in as attorneys— the first mamed appointed Prosecutor. This Grand Jury made no presentments or inditements* The court allowed them 75 cents each for their one day's attendance. They also allowed John Rikfey two dollars for his two day’s service as Judge, certifying these to theCounty Commissioners. First marri age license issued to David Scott and Mary Stevens.The next term of court, probably, was holden at VeraaiUes, March, 1819, Judge John Watts presiding, probably the same associates. Tne first case was m assumpsit, Jero. Burchfield against Cyrus Webster. This case resulted in a personal encounter, in which Burchfield received a severe drubbing.1 have not, 1 think, heretofore men tioned James Steel. He was a fairly educated man from Kentucky, of good sense and some culture. He was our first county Surveyor, and, although along in years when I first knew hi he lived, I think as late of 1140. He h^d three daughters, all of whom 1 knew—Mrs. Conard Overturf, Mrs. human Andrews, who lived near Versaill es, and was a very prominent and worthy citizen, the youngest daughter, Polly, with whom I was best aquaroted, married some one whose name X do notrememhea*.
