Reuben Smltley Takes Refuge In theMountain.Du It BAR, June 7. [Special] —Reuben Smitley, instead of Abe Hmitley as wasmentioned a few days ago, who beat his aged mother last Sunday afternoon, is under arrest but has not yet been captured. It will be remembered that Hmitley severely beat his mother for taking the side of his nephews who had been branding him as a blackleg. Monday informations were entered against him for felonious shooting and attempt to murder, assault and battery, and carrying concealed weapons. Constable Cole of Dunbar township and a posse of citizens went after Hmitley to make the arrest but were unable to capture him. When Smitley saw the officers coming he took his shot gun and retreated to a hill a short dirtance above the house. The officers approached but Smitley fled to the mountains. Yes* tcrday morning word was received here that Smitley returned and had made an attempt to kill his father. His father fearing to remain in the same house with his son took his wife, who has recovere d somewhat Irom her injuries, and prepared to leave. Beuben got into some trouble with his father and after he started ft red three shots after him, one of w hicfrjfrazed his head. Officers again went after him but he could not Ikj taken. He had fled to the woods and was heavily armed.An effort will likely be made to have Smitley brought to Justice if men can be found who are willing to take the risks of capturing him. The charges preferred against him are sufficient to give him a trip to the penitentiary if he Is convicted.Smitley has been employed at the HillFarm mine since the strike has been going on. He has never been known to be lawless In anyway, but for a long time there has been trouble between the different members of the family over their father's land.
