irISTAKEN IDENTITY.]*A cJuror 1 Who Looked Like thePrisoner,Amusing Mistake of a Witn in the Alien Circuit Court—Notes.The circuit court was Monday engaged in hearing the case of the state against Albert Sarber, charged with stealing copper wire from the electric light company. The prisoner is represented by J. R. Bitten-ger, and Prosecutor Colerick and H. C. Hanna are for the state. The sweltering heat of the court room was forgotten a few moments yesterday in the hilarity which followed an amusing episode. During the taking of the testimony one of the witnesses for the state testified that he had seen the prisoner, Sarber, carrying a bag of the stolen wiretowards a junk dealer’s shop, and being asked if the prisoner was in the court room said:“Yes.”“Well point him out then,” said the attorney.“That is him,”replied the witness, pointing to one of the jurors sitting in a chair at the end of the jury box.The juror was dumbfounded for an instant, but soon recovered from his embarrassment to join with the attorneys in the laugh that followed atm Ohis expense, while the prisoner, who was hid from the witness by the projection of the judge’s desk, smiled at his lucky escape from being identified.The case went to the jury last evening, but at a late hour no agree-o’ ~ ‘•'r'ment had been reached. The casesagainst James Cahill and Horatio Weist, implicated in this same transaction will be heard to-day.md
