A jury in Allegany County Circuit Court returned guilty verdicts Wednesday against an Oldtown Road man on two counts of assault and one of reckless driving.Associate Judge J. Frederick Sharer ordered a pre-sentence investigation of the defendant, Mike Franklin Friend, 23, of RD 1, Box 150.Kenneth J. Drumm, city, was foreman of the jury of five men and seven women.The case was heard on appeal from District Court. Friend filed the appeal after Judge Miller Bowen found him guilty of all three charges Feb. 4. At that time the defendant was sentenced to two concurrent six-month terms in custody of the Division of Correction for assault, and fined $150 for reckless driving. Judge Bowen suspended five months of each jail term and placed Friend on supervised probation for 36months.Friend was found not guilty Feb. 4 of a charge of breakingand entering.The defendant was released Jan. 3 after $500 property bondwas posted for his appearance in District Court.The charges were filed by Clifford J. Friend, then residing at 51 Oak Street, and Carol L.. Friend, formerly of 214 Decatu \ Street. Both now reside in Ridgeley, W.Va., and testified for the state at Wednesday’s trial.In her complaint, Carol Friend said she was about to get into her car on Decatur Street Dec. 25, 1984 when the defendant gunned the motor of his truck, headed toward her “and missed me by about eight inches.”Clifford Friend told authorities the defendant broke into his shed on Route 4 Aug. 19, 1984 and ransacked it. On Aug. 20, 1984, Mike Friend tried to break into the Oak Street residence and threatened him and his family, Clifford Friend said in his complaint. He added that the defendant later returned and tried to run over him with his truck.Defense attorney William J. Trozzo called the defendant to the stand Wednesday. Other defense witnesses were BeulahFriend, 201 Grand Avenue, and June Ensweller.Assistant State’s Attorney James P. Donahue Jr. appeared for the state.
