Gene Kloss said today that Walls did not request an attorney when thesecond statement was taken.“If he would have asked for an attorney we wouldn't have taken* (the statement),** Klosssaid today.Deputies talked to Walls a second time to see if he hadanything to add or change from his original statement, Kloss said, but claimed that the two are similar in content.Whether Walls was too intoxicated to waive his right to counsel when tjie first statement was taken is up to a judge to decide, Kloss said.Last month, an Ector County grand jury indicted Walls on charges of shooting at deputies Carl Rogers, Gerald Gray and Hershel Callendar after the deputies responded to a shooting complaint at a west Odessa trailer park.Rogers sustained wounds to 'the head when struck by a round of buckshot that shattered his patrol car’s windshield and was held overnight at Medical Center Hospital.Walls, meanwhile, suffered a bullet wound to his shoulder when deputies returned fire, according to earlier published reports.The bullet remained in Walls’ body until Tuesday when it wasremoved by a Medical Center physician, Jordan said. Walls then was returned to the Ector County Jail where he remained today in lieu of three $,50,000' bonds, according to a jail spokesman and court records.In his order granting psychiatric and psychological exams, Ater instructed doctors to determine whether Walls was sane on April 29 at the time of the shooting and whether — as a result of severe mental disease or defect — Walls didn’tknow his conduct was wrong.The phrase “mental disease or defect” does not include repeated. criminal or antisocial conduct, Ater said.Jordan said he expects the case to be brought to trial at the end of July. ■ *
