SUES FOR$10,000.00Sac and Fox Indian Doctor Brings Suit for Damages.Y-Ta-Tah-Wah Claims Ho tfas Unlawfully imprisoned.Sheriff and Indian Agent Defendants in the Case.Cedar Rapids, Iowa, June 4.—A rather peculiar suit, was illed on Saturday with Deputy Clerk J. O. Stewart of the federal court, and one that promises to attract a considerable amount of attention. The case is that of Y-Ta-Tah-Wah or Wa-Ta-Ta-Wa vs. H. H. Re-bo k and Claus H. Tode and H. M. fte-bok as United States Indian agent of the Sac and Fox Indians, and Claus H. Tode, as sherjii of Tama county, Iowa, Jacob W. Lamb appears as attorney for the plaintiff.In his petition the plaintiff sets forth that he Is 80 years old; .that all his life he has been and lived and still lives a tribal Indian in and under the tribal laws and ujges as one of the Sac and Fox Indians and has lived at the settlement in Tama county, Iowa, for over thirty-five years last past. Thathe is not and never has been a citizen of the state of Iowa, nor subject to the jurisdiction nor the laws of: the state of Iowa. All ot wnii was well known to the defendants hereinafter at the time of the committing of the unlawful' acts hereinafter complained fof;' that the defendants are citizens of the United States.That he has been a regular Indian doctor or nurse of good reputation and standing among and with his tribal people for over fifty years, and all that time made it Iris special work to care for, cure and heat the sick and suffering; of his trine. He has never been accused of any. criminal act, nor was he • ever .arrested until the facts hereinafter.eomplained of.The petition goes on further to state that on or about Jan. 13, 1899, while ipeacefully and lawfully attending to his own. private affairs and. duties .and. serving the sick and needy of his.own. tribal .people at his home he was. arrested, .on a warrant issued by A. ,T. .Dingee, .justice of the peace, through the. .efforts. of H. M. Rebok, .then Indian agent, charging him withthe crime of practicing.medicine without a license or .certificate from the slate board of examiners, of Iowa. That Rebok, then Indian agent And. Tode as sheriff, conspired together unlawfully with'a corrupt intent imprisoned your petitioner.The petition further states that on Jan. 18, 1899, they unlawfully caused him t,o appear for preliminary hearing and caused him to be unlawfully bound ever. That by reason thereof he was deprived of his liberty and kept in a close and damp and unhealthy jail for weeks foltowing Jan. 13, 1S99, until by reason of neglect his peace of mind was destroyed and health broken, down and destroyed.The petition then goes on to state that the grand jury failed to indict.He therefore asks damages in the sum of §10,000 for such unlawful and unjust imprisonment and injury to his health and public disgrace.
