ROTHTimes Staff WriterA charge of rape filed against a Cumberland Township man has been dismissed by the Adams County Court.President Judge Oscar P. Spicer, also ordered Carl G. Woeraer, 51, of 5 Herr’s Ridge Road, Gettysburg, to stand trial on charges of indecent assault and corruption of the morals of a minor in connection with a Jan. 14 incident.The charges were filed against Woerner by Trooper Dennis Kern of the state police at Gettysburg. Police allege that Woerner had intercourse with a 14-year-old girl who had accompanied him on a snow plowing job. The incident occurred to the rear of the Gettysburg Country Club.Woemer’s attorney, Jeffery M. Cook of Gettysburg, filed a writ of habeas corpus requesting that all charges be dismissed.Woerner claims the sex act was consensual. State law establishes the age of consent to engage in sexual activity as 14. At a preliminary hearing held earlier this year, another rape charge filed against Woerner was dismissed.At that hearing, the victim testified that after parking, Woerner “scooted” over, lifted her sweatshirt and began touching her.Later, he asked her to get into the back of the truck, where they had sex.
