Counsel for the prisoner objected and the admissibility of the testimony.was debated, the Court ruling the evidence proper.Monday night was a time of many alarms, and there was uneasiness among all the people anywhere near the vicinity of the public square, where a great crowd, numbering several hundred, gathered early. Many remained there until near morning, and rumors of threatening attack on the jail filled the air. In some manner an absurd story was circulated in certain quarters that a prison sentence only bad been agreed upon to heimposed on the negro, and this caused some of theed the people of the county on their general ohservance of the law and their respect for its mandates. Very gravely, stilj, he warned his bearers against manifestation of approval or disapproval of the decision to he rendered in this case, stating that any demonstration would be stopped by the strong hand of the officers and those responsible therefor punished. He then pronounced ••Wish Sheppard guilty, and told the prisoner to stand up. While thus standing Sheppard was asked whether he bad anything to say before sentence was passed upon him, and be said he had nothing to say. Then Judge Constable asked the prisoner’s counsel if he* had anything to say for the prisoner, and Mr. Lewis said he had nothing to say. Continuing, the Judge said to Sheppard:••Youelected to be tried by thejudges.of said deceased; approved, and ordered to be recorded.. Norman Pippin, executor of John O.
